These Terms of Service ("Terms") govern your access to and use of KeloAI's website and platform (the "Service"), operated by KeloAI ("we," "us," or "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
You must provide accurate and complete information when creating an account and keep it up to date. You are responsible for safeguarding your account credentials and for any activity that occurs under your account. Notify us immediately if you suspect unauthorised access.
KeloAI allows you to build, configure, and deploy AI-powered assistants using your own content and connected systems. You may use the Service only in compliance with these Terms and applicable law, and only for legitimate business purposes.
You retain all rights to the documents, data, and other content you upload or connect to the Service ("Customer Content"). You grant us a limited licence to host, process, and use Customer Content solely to provide and improve the Service to you. You are responsible for ensuring you have the necessary rights and permissions to upload and use Customer Content on the platform.
Assistants built on KeloAI generate responses based on the content and systems you configure. While we work to make responses accurate and relevant, AI-generated content may occasionally be incomplete or incorrect. You are responsible for reviewing and validating assistant responses before relying on them for important decisions, and for configuring your assistant appropriately for your use case.
Paid plans are billed in advance on a recurring basis as described at checkout or in your order form. Fees are non-refundable except where required by law or expressly stated otherwise. You may change or cancel your subscription at any time; changes take effect according to the billing terms presented to you at the time of the change. We reserve the right to change our pricing with reasonable advance notice.

The Service, including its software, design, and branding, is owned by KeloAI and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding except as necessary to use the Service as intended.
The Service may allow you to connect third-party systems or services. We are not responsible for the availability, accuracy, or practices of any third-party service, and your use of them is subject to their own terms and policies.
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, or if required to do so by law. Upon termination, your right to use the Service ceases immediately, though certain provisions of these Terms will survive termination as necessary to give them effect.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated responses will always be accurate or complete.
To the maximum extent permitted by law, KeloAI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising out of these Terms will not exceed the amount you paid us in the twelve months preceding the claim.
These Terms are governed by the laws of Kenya, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Kenya, unless otherwise required by applicable law.
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the platform before the changes take effect. Continuing to use the Service after changes take effect constitutes acceptance of the updated Terms.
